1. Scope of Application

These General Terms and Conditions (GTC) apply to all orders placed through our online shop smilecards.store by consumers within the meaning of § 13 German Civil Code (BGB).

3. Offer and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. By completing the order process, you submit a binding offer to purchase the selected products. The contract is only concluded upon our explicit acceptance declaration or dispatch of the goods.

4. Prices and Payment Terms

All prices are stated in Euro and include the statutory value-added tax (VAT). Shipping costs are displayed separately during the checkout process.

The available payment methods (e.g., credit card, PayPal, Klarna, Sofortüberweisung, Apple Pay) are displayed during checkout. Payment is due immediately upon conclusion of the contract.

5. Shipping and Delivery

Delivery is made exclusively within Germany to the address provided by you. Delivery time is usually 1–3 business days, unless otherwise stated for the respective product.

6. Livestream Openings & Exclusion of the Right of Withdrawal

For products (e.g., Pokémon booster packs) that are opened during a livestream at the customer’s explicit request, the right of withdrawal expires in accordance with § 312g para. 2 German Civil Code (BGB), as these are sealed goods whose seal has been removed.

Cards from opened products are considered individually allocated and are excluded from exchange. Statutory warranty rights remain unaffected.

7. Retention of Title

The goods remain our property until full payment has been received.

8. Warranty

The statutory warranty rights apply.

9. Liability

We shall be fully liable in cases of intent and gross negligence. In cases of slight negligence involving the breach of essential contractual obligations (cardinal obligations), liability is limited to the foreseeable damage typical for the contract. Liability for damages resulting from injury to life, body, or health remains unaffected.

10. Applicable Law

German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the country in which the consumer has their habitual residence remain unaffected.
